State Specific Privacy Notice
This State Specific Privacy Notice (“Notice”) applies to Consumers and Business Contacts (“you” or “your”) who are residents of U.S. States that have enacted comprehensive privacy laws. It pertains to the personal information we collect through our Website and Services and describes your rights and choices with respect to the processing of your personal information under the applicable state laws. This Notice does not apply to Madhive, Inc. (“Company”) employees. It also does not apply to individual business information collected from you in your capacity as an employee of our media or supply partners and clients. This Notice is in addition to the information in our general privacy policy, which can be found here (the “Privacy Policy”). In case of any conflicts between this Notice and the general privacy policy, this Notice shall prevail. Capitalized terms not defined in this Notice are defined in our privacy policy.
U.S. DATA SUBJECTS
Certain U.S. states (provide additional privacy protections for their data subjects under applicable law, including: (a) the right to see what data we have about you, (i.e., the right to know); (b) the right to delete the data we have about you, (i.e., the right to delete); (c) the right to correct the data we have about you, and; (d) the right to opt-out of the sale/share of data about you (i.e., the right to opt-out from sales/sharing of your information) or the right to opt-out of targeted advertising and/or profiling . Most of these rights are also applicable to the pseudonymous personal information collected about your computer or device by the Platform and Services. We do not discriminate against you if you exercise any of the above rights. Moreover, we may not be able to honor a right if doing so would violate applicable law. You may access those rights with respect to Madhive exclusively by accessing our Privacy Center at this link or, if you are a California resident, by calling our California privacy help line at 1-866-467-8688 (Service Code: 1803). We will confirm your request within 10 days and make a good faith attempt to fulfill your request within 45 days unless applicable law provides that we do so more quickly.
In the last 12 months, we have “sold” personal information (as defined by the CCPA), including: (a) certain pseudonymous identifiers collected as part of our Services, including IP address, to our Customers to conduct their own measurement or attribution related to the performance of their ad campaigns, (b) via the third-parties operating on our Website.
Madhive is a data broker under Texas law. To conduct business in Texas, a data broker must register with the Texas Secretary of State (Texas SOS). Information about data broker registrants is available on the Texas SOS website at https://texas-sos.appianportalsgov.com/data-broker-registry
Your Rights
Residents of California, Delaware, Indiana, Iowa, Kentucky, Maryland, Minnesota, Montana, Nebraska, New Hampshire, New Jersey, Oregon, Rhode Island, Tennessee, Texas, Virginia, Colorado, Connecticut, Nevada, Alabama, Oklahoma, Louisiana, and Utah have specific rights regarding their personal information, as detailed below.
If we received your information from one of our media buying Customers, you will need to make the request directly to that media buying Customer, unless they have authorized us (as their service provider) to respond directly to you.
● Right to Access—You have the right to request access to the categories of personal information we collected about you, the categories of sources of this personal information, the categories of third parties to whom we have disclosed this information, and the specific pieces of personal information we have collected, used, disclosed, and sold.
● Right to Correct—You have the right to request that we correct any of your personal information that we store.
● Right to Delete—You have the right to request that we delete any personal information that we possess on you, subject to any applicable legal exceptions.
● Right to Opt Out of Sale/Sharing of Personal Information or Processing for Targeted Advertising—You have the right to “opt out” of the sharing or sale of your personal information to third parties (as defined by the applicable laws) or the use of your personal information for targeted advertising You may exercise your right through the following link on the bottom of this page.
● Right to Third Party Information – Residents of Oregon, New Jersey and Delaware have the right to request a list of the specific third parties we have disclosed your personal information to.
● Right of No Discrimination and No Retaliation—We shall not discriminate or retaliate against you for exercising any of your rights under any applicable law.
● Right to Appeal—Residents of Colorado, Maryland, Nebraska, New Hampshire, New Jersey, Texas and Virginia have the right to appeal if you disagree with our response to any request or if we decline to take action regarding any request under the applicable laws.
Exercising Your Rights
To exercise your rights detailed above, please submit a verifiable consumer request by accessing our privacy center here and provide your full name, email address, IP address, and the type of request you are making (e.g. access, deletion, etc.). To exercise your right to access you will also need to provide a device identifier, such as a MAID or a CTV ID. Before completing your request, we may request additional documentation or information solely for the purpose of verifying your identity.
Depending where you reside, you may be entitled to empower an “authorized agent” to submit requests on your behalf. To submit a request, you must use the form located in our privacy center here. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws.
