Madhive Creative Policy

Here at Madhive we are the trusted partner for local media professionals, allowing you expand reach through efficient, high-impact CTV campaigns. Our platform provides the unique ability to reach local audiences at national scale.

To do this, we've developed advertising guidelines to help you understand what can (and cannot) be included in campaigns on our platform. Please keep in mind, Madhive reserves the right to reject or block any content for any reason at our sole discretion, even after post-launch, if we feel that it compromises the safety or quality of the user experience. Also, our publishers and platform partners can choose to block campaigns that they don't feel resonate with their brands.

Creative (i.e., ad units, landing pages, or other content related to or used in connection with the serving of ads on our platform) must comply with the guidelines below.  

Advertisers are responsible at all times for the content of their advertising and their compliance with this Creative Policy.

It is the responsibility of the advertiser to ensure that the Creative they upload to the Platform is properly categorized utilizing the IAB categories provided in the Platform. Failure to do so may result in a suspension of the advertisement until such time as the content has been properly categorized.

This policy applies to all Creatives run through our platform, including ad units and landing pages associated with the Creatives.

Prohibited Categories

a. Illegal Products or Services

Products or services that are illegal in the state they are being marketed cannot be placed on our Platform.

b. Illegal Drugs and related products

Creative promoting the sale of drugs or pharmaceuticals that are not legal under US federal law cannot be placed via the Platform. This includes the advertising of all accessories and paraphernalia used in conjunction with that illegal substance.

CBD is covered below in the restricted content category and THC may be promoted in state where it is legal to do so.

c. Weapons, ammunitions, explosives

Creative that features the sale of, or instructions to create guns, ammunition, bombs, or other weapons cannot be placed on the Platform, subject to certain exceptions outlined below under Restricted Categories.

d. Adult content

Creative that includes pornography, sexual or sexually suggestive content, nudity or explicit images cannot be placed on the Platform.

e. Misleading or false content/scams

Creative for scams or fake products or services (including deceptive professional services) or advertising content that makes misleading, fraudulent, deceptive or false claims (whether intentional or not) cannot be placed on the Platform.

f. Profane, graphic or violent content

Creative that includes any vulgarity, profanity, obscene language, swear words, crude content, graphic content, or violent content cannot be placed on the Platform.

g. Counterfeit documents/products

Advertising for counterfeit products, services or documents cannot be placed on the Platform.

h. High Risk of Fraud

None of the following may be placed on the Platform:

  • Creative that encourages high-risk investments or money-making schemes with the intention of profiting off user participation (i.e. "Get Rich Quick" Schemes)
  • No Payday Loans or Cash Advance Loans
  • No Penny Stocks, or Binary Options
  • No bail bonds, currency exchanges, or credit repair services
i. Hate speech

Content that promotes or disparages, intimidates, expresses hatred for or demonizes or bullies a group, incites hatred based on a person's race, ethnicity, national origin, gender, religion or other characteristic will be banned from the Platform. The Company will not accept any content that incites violence or prejudicial action towards a protected individual or group.

j. Spyware/malware

Content containing adware, malware, spyware, virus, Trojan Horses, or other features designed to infiltrate or damage computer systems or access personally identifiable user information without explicit user consent is prohibited.

Restricted Content

k. CBD & Cannabis

Promotion of hemp-based CBD (cannabidiol) products with less than 0.3% THC is acceptable where CBD is legal.

Promotion of cannabis products shall be acceptable in states where it is legal. Advertiser shall be responsible for compliance with any advertising requirements in the applicable market.

l. Cryptocurrency

Creative may not promote cryptocurrency trading platforms, software and related services and products that enable monetization, reselling, swapping or staking of cryptocurrencies without prior written permission.

m. Alcohol

Any advertising content for alcohol and alcoholic beverages must comply with local laws, regulations or codes for the state in which the advertisement is being targeted or displayed. Advertisers are solely responsible for complying with applicable federal, state and local laws and regulatory guidelines (including age-gating where necessary). Alcohol content must only be targeted at adults over 21 years of age.

Content must not:

  • target minors or display minors consuming alcoholic beverages;
  • associate the consumption of alcohol to having health benefits or improving social, sexual, athletic, or professional performance;
  • imply excessive drinking or that excessive drinking is therapeutic, relaxing, or stimulating;
  • show people under the influence of alcohol;
  • emphasize a product's alcohol strength;
  • associate drinking with activities that require a certain level of skill with coordination (e.g. driving or sporting activities);
n. Tobacco/Nicotine Products

Advertising of products that contain tobacco (cigars, cigarettes, smokeless tobacco, pipe tobacco, vapes, and accessories) shall comply with applicable federal, state and local laws, regulations and codes. This advertising shall only be targeted at adults over 21 years of age and include the proper disclosures and age gates required by law. This also applies to non-tobacco products that contain nicotine.

o. Gambling

Gambling advertising shall be allowed depending on the type of gambling and the regulations surrounding it, as detailed below. For all gambling advertisements, they may only be targeted to adults over the legal gambling age in the state in which the advertising is being displayed. All gambling advertisements must include the “responsible gambling” disclosure required by law. Content cannot guarantee any win rate or percentage.

i. Sports Gambling

Advertising for sports gambling shall only be allowed in states where it is legal to conduct sports gambling. The advertising shall comply with any and all applicable federal, state and local laws, regulations and codes.

ii. Brick and Mortar Casino

Advertising for brick and mortar casinos shall only be allowed in states where it is legal and the advertiser shall provide proof of registration with said state. The advertising shall comply with any and all applicable federal, state and local laws, regulations and codes.

iii. Online Gambling

Advertising for online gambling shall only be allowed in states where it is legal to conduct online gambling and advertisers shall provide proof of registration within that state. The advertising shall comply with any and all applicable federal, state and local laws, regulations and codes.

p. Dating

No advertising for mail order brides, escorts, prostitution, or similar services shall be allowed on the Platform. However, advertisements for online dating platforms, legitimate matchmaking services and similar products shall be allowed.

q. Weapons

Creatives promoting shooting ranges, accessories that aren’t directly sold as part of a physical weapon, as long as they are targeted to people 18 years or older and issue-based advertising may be placed on the Platform.

s. Weight Loss

Advertisements for weight loss products and services shall be accepted as long as they comply with the requirements set forth by the Federal Trade Commission and comply with any and all applicable local and state regulations.

t. Pharmaceutical Products, Services and Devices

All advertising for prescription medication, over the counter drugs, supplements or medical equipment must comply with applicable federal, local and state laws, regulations and codes. The advertiser shall be duly registered and hold the required licenses in order to market their products/services. The Company shall only accept advertising for pharmaceutical products that have been approved by the pertinent authorities (the FDA, for example), that are approved to be sold and marketed in the United States and that comply with the FDAs advertising rules for such products.

u. Family Planning

Advertising for family planning products and services shall be allowed on the Platform on a restricted basis and must only depict the contraceptive features of the product/service. Such advertisements shall not, at any time, depict any sexually suggestive content or focus on sexual claims. Additionally, the content must include the proper disclosures required by the pertinent authorities.

Madhive & Frequence Targeting & Pixeling Policy

Pixeling Policy

The following applies to your placement of Madhive and Frequence Pixels (“Pixels”) on digital properties. The Company may in sole discretion require you to remove pixels that don’t comply with this policy.

General Requirements:
  1. You may place Pixels only on those Digital Properties for which you have the necessary rights and authorizations to do so.
  2. Where data is collected by a third party from your Properties for Interest Based Advertising (‘IBA”), Cross App Advertising (“CAA”) or Retargeting (“Retargeting”), you must provide notice of this data collection and the choices available to Users, as specified in the applicable regional privacy regulations, including, but not limited to, the California Privacy Protection Act, as amended by the California Privacy Rights Act and Personal Information Protection and Electronic Documents Act. IBA refers to the collection of data across web domains owned and operated by different entities for the purpose of delivering Ads based on preferences or interests known or inferred from the data collected. CAA refers to the collection of data through applications owned or operated by different entities on a particular device for the purpose of delivering Ads based on preferences or interests known or inferred from the data collected. Retargeting is the practice of collecting data about a user’s activity on one Digital Property for the purpose of delivering an ad based on that data on a different, unaffiliated Digital Property.
  3. Consistent with the DAA Principles, you may not place Company pixels in toolbars or other locations such that data may be collected from all or substantially all URLs traversed by a web browser across Web sites or all or substantially all applications on a device for IBA, CAA, or Retargeting without Company’s prior review and approval of your consent mechanism. Clients interested in having Madhive review such a mechanism should reach out to their Madhive account manager.
  4. Sites and creatives on which you place Company pixels must comply with all other aspects of this User Policy.

Targeting Policy

General Requirements:

Advertisers may not use targeting options to discriminate against, harass or provoke any person or to engage in predatory advertising practices.

The Company prohibits the use of audiences or targeting segments that would introduce a targeting bias towards groups or populations defined by one or more of the Sensitive Interest Categories and resulting in an inappropriate prejudice in favor of or against those groups. Additionally, in territories where it is restricted, Advertisers may not target based on Sensitive Interest Categories.

Advertisers shall be responsible for ensuring your Ads comply with the law and any applicable policies. Please consult counsel for specific guidance.

Sensitive Interest Categories

  1. Children under 13
  2. Race
  3. Ethnicity
  4. Religious Affiliation or Belief
  5. Sensitive Health Condition
  6. Trade Union Membership
  7. Sexual Orientation
  8. Sexual Interests
  9. Biometric information or genetic data
  10. Criminal History or status

Children

Company pixels may not be placed on Digital Properties directed at Children (“Child-Directed Digital Properties”).

Sensitive Health Data

Company pixels may not be placed on Digital Properties related to sensitive health conditions for IBA, CAA, or Retargeting purposes without the user’s specific opt-in consent. Madhive must review and approve your consent mechanism before you place Company pixels for such purposes.

Clients may place Madhive pixels on Digital Properties related to sensitive health conditions for other purposes, such as Ad Delivery and Reporting (“ADR”) without the user’s opt-in consent. ADR is separate and distinct from IBA, CAA, and Retargeting and refers to the collection of data from a computer or device to (i) facilitate the delivery of an ad, or (ii) provide advertising-related services that are not tied to the end user’s known or inferred interests (e.g., frequency capping).

Content Standards

Madhive has the highest standard for all Ads placed through their Platform. As such, Advertisers must comply with the following Content Standards.

General Restrictions:

Ads shall not:
  • Contain hacking or cracking content.
  • Auto-play audio.
  • Pop-up or pop-under the content of any Property.
  • Auto-refresh
  • Use deceptive tactics such as fake player buttons or prompts or images that pretend to be system prompts.
Ads must:
  • Clearly state the company that is advertising and the product or service or brand that is being promoted.
  • Ensure all the content of the Ad must be relevant to the product or service advertised.
  • Ensure that the products and/or services advertised must match the content of the landing page.
Landing Page

The advertiser’s landing page must link to a working page and should be compliant with all other Ad Guidelines provided by Madhive, including any restrictions on content.

Creatives

Digital Ads, Video and audio must be of clear quality, content must be clearly understandable and it must be clear to the audience that the content is an Ad. Intellectual Property Infringement

Madhive and Frequence have a zero tolerance policy for any content that infringes on third party intellectual rights. As such, Ads may not contain any content that violates the rights of any third party, including, but not limited to: copyrights, trademarks or trade secrets.

Should any Ads be found to violate third party rights, such Ads will be blocked within twenty four (24) hours of notice or discovery.
